NexBlue Terms and Conditions
1. General
NexBlue develops, manufactures, and supplies EV charging hardware and associated smart energy solutions. This includes software, mobile and web applications, APIs, and cloud-based services that enable monitoring, control, and integration with external systems. NexBlue distributes its products directly or via approved partners and installers. NexBlue retains all intellectual property rights to the products and services provided, whether offered free or for a fee.
This document governs the use of all NexBlue offerings, including NexBlue charge points, the myNexBlue mobile app, the NexBlue Partner App and Portal, the NexBlue Website, and any APIs or related digital services ("NexBlue Products and Services"). These Terms apply to all Users and Installers, whether for personal, commercial, or public sector use.
NexBlue Ltd. is the sole owner and operator of all NexBlue Products and Services.
Use of NexBlue Products and Services is also subject to our Privacy Policy, Partner Terms (where applicable), and any written agreements between NexBlue and its users. By accessing or using any NexBlue service, you agree to these Terms. If you do not agree, you must not use our products or services.
2. Definitions
2.1 Terms: This document and any future updates to it.
2.2 NexBlue Charge Points: EV charging hardware developed and manufactured by NexBlue for domestic and commercial use.
2.3 Location: A singlular site where NexBlue Products have been installed by an Installer, both physically and within the NexBlue Cloud.
2.3 myNexBlue App: Mobile app used by Users to monitor and control NexBlue charge points.
2.4 NexBlue Partner App & Portal: Tools for Installers to install, configure, and monitor NexBlue devices and systems.
2.5 NexBlue X Portal: Tool for specific Partners to configure and monitor NexBlue devices and systems, access determined by NexBlue.
2.6 Installers: Certified professionals authorised to install NexBlue hardware and commission charge points via the Partner App and Portal.
2.7 Partners: Installers and Customers who access NexBlue Products through the NexBlue Partner App and Portal or NexBlue X Portal
2.8 Users: Individuals who use the myNexBlue App to access NexBlue products. Users can include both Owners and Shared Users.
2.9 Owners: Users who have had the ownership of a NexBlue Location transferred to their account. Owners have full administrative control over all products installed at the location, and can share limited access with additional Users.
2.10 Admin: For a Multiple Dwelling Unit (MDU) Location, Admin permissions are determined by the Owner of the Location. Admins have full administrative control over the product(s) shared with them, and can share Admin or User access.
2.11 Shared Users: Users who have been granted limited access by an Owner to operate a specific charge point or charge points.
2.12 NexBlue Cloud: Cloud infrastructure used to store data and power connected services across NexBlue apps and platforms.
3. Acceptance
By registering as an Installer or User, and accepting these Terms, you enter into an agreement with NexBlue Ltd. This agreement allows you to access and use NexBlue Products and Services. You confirm that you are over 18 and accept the terms electronically. Communications regarding service updates or changes will be sent via email, SMS, or push notification, and may not be opted out of.
4. Use of NexBlue Products and Services
NexBlue Products must be installed by trained Installers using the Partner App or be pre-configured using the tool in the Portal. Control of NexBlue Products by Owners and Users can either be done through the myNexBlue App or an approved OCPP or API connection.
The NexBlue Cloud Services enable:
- Device setup, commissioning, and configuration
- Smart charging features and energy balancing
- Real-time monitoring and diagnostics
- Remote control and scheduling of charge sessions
- Management of user access and permissions
- Access to NexBlue Support and diagnostics
5. Account Registration
To access NexBlue Cloud Services, Installers must create an account with a valid phone number, name, and email. Users must create an account with a valid name and email, phone number is optional. Users must maintain accurate and current information. You are responsible for safeguarding your credentials and any activity under your account.
NexBlue may suspend or terminate accounts with outdated or false information, or where Terms are breached.
6. Partner Obligations
Installers must:
- Be certified and competent to carry out electrical installations.
- Use the NexBlue Partner App or Portal to commission devices.
- Ensure installations comply with safety and legal standards.
Partners must:
- Report software or hardware issues to NexBlue in a timely manner.
- Be responsible for any use of the NexBlue Cloud Services made via their access.
7. Third-Party Services
NexBlue Products may integrate with third party systems. Use of such integrations is subject to their respective terms. NexBlue does not guarantee compatibility or ongoing support for third party services. NexBlue is not liable for issues arising from third party integrations.
7.1 EcoPilot - Charging Schedule Accuracy
NexBlue utilises third-party services to obtain energy pricing data and to calculate optimised charging schedules. While NexBlue makes reasonable efforts to ensure that such pricing data and schedules are accurate and up to date, delays, inaccuracies, or interruptions may occur due to factors outside NexBlue’s control.
Where pricing data is not updated in a timely manner, charging sessions may not be scheduled at the lowest available tariff and may result in higher charging costs than anticipated. NexBlue accepts no liability for any additional costs incurred as a result of delayed, unavailable, or inaccurate pricing data or scheduling updates.
7.2 Energy Supplier Integrations
NexBlue is not responsible for charging sessions that occur outside of off-peak tariff periods. While NexBlue and its partners will make reasonable efforts to optimise charging to take place at the lowest available energy rates, NexBlue does not guarantee that charging will always occur during off-peak periods and accepts no liability for any charging that takes place outside such times.
8. User Responsibilities
You are responsible for keeping your access credentials secure and for the activity carried out under your account. In case of a lost mobile device or access breach, you must notify NexBlue to disable or secure access.
You may not copy, reverse-engineer, or reproduce any part of NexBlue’s software or hardware. NexBlue retains all rights and licenses not expressly granted.
9. Grid Flexibility Participation (UK Mainland Only)
9.1 Introduction
Please read these Terms and Conditions carefully. These Terms and Conditions apply to the FlexShare (the “Service”). By entering the Service, you agree to be bound by the following Terms and Conditions:
- These Terms and Conditions, together with any specific rules set out in any communications relating to the Service, are the Service rules (“Rules”) and apply to this Service. By entering this Service, you are agreeing to be bound by these Rules and any other applicable instructions.
- NexBlue UK Ltd reserves the right to cancel or amend the Service and/or the Rules, you will be notified of any material revisions 30 days prior to changes or additional terms taking effect. Any changes will be posted on our website. These Terms and Conditions were last updated in 22/12/2025.
- In the event of any dispute regarding any aspect of the Service, the decision of NexBlue UK Ltd shall be final and binding.
- By accepting these Terms and Conditions, you consent that you allow NexBlue UK Ltd and our partners to access your connected NexBlue UK Ltd devices (“Flexible Devices”) for us to deliver the Services. A full explanation and description of the Service is set out below.
9.2 About us
- NexBlue UK Ltd, registered in the United Kingdom with registered company number 15814357 and registered office at 71-75 Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ (“ NexBlue UK Ltd”, “we”, “us”)
9.3 Details of the Service
- In Great Britain, various electricity balancing and flexibility programs ("Grid Services") are offered to help the electricity grid. These are managed by different grid and market operators ("Programme Operators"). Each programme has its own eligibility criteria and specific rules. Examples of these Grid Services include the Demand Flexibility Service provided by the national energy system operator for Great Britain (“NESO”), and local network flexibility procured by Distribution Network Operators (DNOs). NexBlue UK Ltd, its partners and data sub-processors, including but not limited to Axle Energy (“Partners”) will assess, enroll, manage, and reward Flexible Devices in Grid Services, based on location, technical specifications, preferences, and the availability of such services.
- We automatically enroll your Flexible Devices to support overall grid stability. This will work by briefly adjusting the Flexible Devices’s operation during periods of high stress for the grid. Under normal circumstances, we do not expect this service to materially impact your day-to-day Flexible Device usage, as these adjustments will be infrequent, and pauses or modifications to device operation will be for short periods only.
- At other times, Partners will control your Flexible Devices to adjust the overall electrical supply or demand on the network (“Events”). Where necessary, we may automatically vary the rate of production / charge / discharge from your Flexible Devices during or in preparation for Events.
- The Service is offered on a best-effort basis, with no guarantee on the frequency of Events or the potential value of rewards due to evolving program rules and market conditions. The Service and these Terms and Conditions are subject to the applicable terms of the Programme Operators, and we accept no liability if the Programme Operators amend or terminate their terms.
9.4 Rewards
- Participation in the Grid Services makes you eligible for rewards based on your Flexible Device's performance (“Rewards”). We cannot ensure that the Service will result in any Rewards.
- Any rewards will be visible in the FlexShare section of the myNexBlue App.
- Rewards will be credited monthly to a digital account managed by Partners. You can use this account to view your rewards history and check your balance.
- Rewards exceeding £15.00 can be redeemed via bank transfer. By agreeing to these Terms and Conditions, you consent to receiving payments via bank transfer and confirm that you have a UK bank account.
9.5 Eligibility and Participation requirements
- To be eligible to participate in the Service, you must at all times comply with these Terms and Conditions and, be 18 or over, be a resident of Great Britain. To be eligible for Smart Control, a part of the Service, you must also have a working electricity smart meter (SMETS1 or SMETS2 electricity meter) that is actively communicating with the DCC and has done so for a period of at least 30 days prior to requesting to join the service, have a registered import MPAN, associated with your address in the database of Smart DCC Ltd, regulated by Ofgem (“DCC”), opt-in to the Service, not be participating in the delivery of Grid Services or any similar service for NESO or any Distribution Network Operator, either directly, via an energy supplier, or another third party, and consented to, and not remove your consent, to give us and Partners access to your half-hourly smart meter reads.
- Initial and/or ongoing participation in the Service may require firmware upgrade/s to your Flexible Device, and we reserve the right to remotely update firmware as necessary during the Service. Partners will control your Flexible Device to deliver the Service, with your consent for control during Events and any required preparation periods.
- The number of Events is not guaranteed, and participants cannot choose which Events to join, though deregistration from the Service is always an option. Metered data from your Flexible Devices and smart meter will be used to calculate your contribution and determine any Rewards earned from Events.
- We are not liable for reimbursing any expenses incurred in connection with joining the Service.
- For certain programs within the Grid Services, eligibility for Rewards requires achieving a reduction in electricity import or an increase in electricity export to the grid, as measured against a "Baseline" using data from your smart meter. Where applicable, the Baseline will be determined according to the specific baselining rules of each program.
- We reserve the right to limit mode availability or decline registration for participants using unsupported modes as certain modes may not be compatible with the Service.
9.6 Service Terms and Liability
- Flexible Devices can typically participate in most Grid Services with only one provider at a time. Enrolling in our Service, if you are already registered for Grid Services with another provider, will render you ineligible to continue with the previous Grid Services provider. We are not responsible for notifying you of removal from any other service due to dual registrations or for any financial or other consequences arising from such removal. Registering with another Grid Services provider after joining our Service may result in disqualification from our Service.
- We are not responsible for any loss, damage, injury, or incidental, indirect, special, or consequential damages (including, without limitation, lost profits or energy loss) arising from or related to the use or inability to use the Service. Participation in the Service is at your own risk and is provided on an "as-is," "where-is," and "where-available" basis.
- To the fullest extent permitted by law, we disclaim all representations, warranties, and conditions (express, implied, statutory, or otherwise), including but not limited to warranties of merchantability and fitness for a particular purpose regarding the Service.
- We in our sole discretion reserve the right to withdraw or vary the Rules and/or any offer made in connection with them in order to comply with the decision of any relevant judicial or regulatory body and shall not be held liable to any participant for doing so.
9.7 Termination
- If we reasonably believe you have violated the Rules, we reserve the right to disqualify you from the Service and revoke any payments.
- We reserve the right to terminate your participation in the Service immediately if any information you have provided is found to be false, inaccurate, incomplete, or misleading. In such cases, any benefits, rewards, or payments associated with your participation may be revoked.
- We reserve the right to temporarily suspend or permanently remove your access to the Service at our sole discretion if, at any time during your participation, the following conditions occur:
- Your Device becomes disconnected from the internet, or your Device is moved to a different location, or
- Your smart meter is disconnected, your meter readings are no longer available in the DCC, or you relocate to a new property, or
- You are no longer eligible under the Service Rules, or
- A technical, operational, or security risk is identified in relation to your access to the Service.
- You may opt out of the Service at any time by contacting us via our Contact Us form which can be found here. Re-registration may not be possible after opting out and is at the discretion of us and our Partners.
- We may terminate the Service at any time and for any reason without prior notice. Upon termination or opting out, we are not obligated to store, maintain, or provide any content, data, or information related to your participation in the Service.
- We or our Partners will only pay participants revenue received directly from the Programme Operators and accept no liability for unpaid amounts beyond what is received.
9.8 Data Protection and smart meter access
- Details of the NexBlue Ltd Privacy Policy can be found here.
- We will share participants’ email, address, Meter Point Administration Numbers, installation record, half-hourly metered energy consumption, energy export, Flexible Device measurements, usage information, records associated with installation and the commissioning process, and other details relating to the participants with Flexibility Scheme Operators, its affiliates and their authorised sub processors to provide the Service including to register participants in the Service and calculate payments to individual participants. Your half-hourly metered consumption and export data will be processed by Partners and their authorised sub-processors by interfacing with the national smart meter systems in accordance with the Smart Energy Code. We will only share your smart meter readings once you have provided your consent.
- We and our Partners could provide Flexibility Scheme Operators with half hourly electricity consumption, export, baseline and reduction data and the value of any incentives used in an aggregate manner, for the purposes of delivering the Service. In some cases, Flexibility Scheme Operators may request detailed half hourly data around the Events to audit performance and payment, which may include consumption and export data on an individual participant basis.
- You may withdraw your consent to the sharing of your smart meter energy data at any time by withdrawing from the program by contacting us via our contact form. If you withdraw your consent, we will stop accessing your smart meter data via the national smart metering system and will stop sharing your smart meter data with Flexibility Scheme Operators for future Events; as a result, you will no longer be able to participate in Services that require smart meter data, including flexibility or demand response services. Withdrawal of consent will not affect any data already shared or used lawfully before your withdrawal, or any data we are required toretain to meet legal, regulatory, or audit obligations.
- We, our Partners, and approved sub processors on its behalf may share and process the above information. By entering the Service you agree that your above information will be processed and used as such.
- By entering the Service, you agree to receive communications from us or Partners in connection with your participation in the Services.
- We and our Partners and/or authorised sub-processors shall retain settlement calculations and data regarding your participation in Grid Services per the terms of each Flexibility Services’ program rules.
- By entering the Service, you agree that your above information will be processed and used as such

10. Liability
NexBlue Products and Services are provided "as is" and "as available." We do not guarantee uninterrupted access or service availability.
NexBlue is not liable for:
- Indirect, incidental, or consequential damages
- Loss of profits, data, or revenue
- Failures due to third-party infrastructure or user misuse
- Total liability beyond the price paid for products/services in the past 12 months
Nothing in these Terms excludes liability for fraud, personal injury, or death caused by negligence.

11. Support Services
NexBlue provides:
- Direct support to Users of NexBlue operated products
- Tiered support to Installers and Partners
Support is available during working hours and via our official channels.
12. Personal Data
By using NexBlue Products and Services, you agree to the collection of pseudonymised device, site, and user activity data. This is required to maintain functionality, safety, and compliance. NexBlue acts as:
- Data Controller for end user account and product data
- Data Processor where acting on behalf of Partners using NexBlue APIs

13. Marketing Consent
You may receive product updates, offers, and news. You can opt out of marketing communications via your account settings. Transactional or service messages cannot be disabled.
14. Right to Use
All content in NexBlue platforms, including software, images, integrations, and materials, is owned by NexBlue and protected by IP law. No rights are transferred except those explicitly granted by these Terms.
15. Service Limitations
NexBlue may suspend access to services for maintenance, safety, legal, or operational reasons without prior notice.
16. Termination
These Terms remain in effect while you use NexBlue Products and Services. NexBlue may terminate or suspend access for violations. No refunds are guaranteed. Users may terminate accounts by contacting NexBlue Support.
17. Changes to Terms
NexBlue may modify these Terms at any time. Users will be notified of material changes. Continued use after a change implies acceptance.
18. Complaints, Governing Law & Disputes
These Terms are governed by the laws of the country in which NexBlue products have been installed in. Disputes must be settled under the applicable legal framework.
